Strong Institutions on paper, Weak Justice in Practice: The NGO-Implementation Gap in Governance Reforms in Pakistan

Abstract

Governance reforms in Pakistan present a chronic anomaly where strong legal institutional frameworks exist on paper but bad governance is reflected in poor justice delivery on the ground. This article questions this disconnect by representing it as NGO Implementation Gap. Moving away from the narrow individual state capacity or political will approach to examining state reform often found in conventional diagnosis, the analysis highlights the important, yet under examined, role of non-governmental organizations (NGOs) as the architects and intended drivers of reform. Employing a multi method qualified approach providing a synthesis of legal doctrinal research, case study data on both the police and Right to Information reforms, as well as insights from a professional legal and international relations working practice, this article argues that a strategic and structural disjuncture is a feature of NGO engagement. Although NGOs have access to technical expertise and advocacy skills, they tend to have a donor proposition that is project oriented, creating rationales for formal institutional creation rather than building sustainable political constituencies and negotiating entrenched informal power structures. Consequently, as NGOs draw up complex legal blueprints, their efforts are routinely defeated by bureaucratic inertia, patronage networks and lack of embedded societal accountability. The article concludes that overcoming the implementation gap requires a fundamental reorientation of reform strategies from technical assistance to politically engaged, long term coalition building with theoretical and practical implications for the reconceptualisation of the institutional strengthening in hybrid governance contexts.
